These terms are the agreement between you and Qojix when you use Qojix. Please read them; the sections on AI workers, WhatsApp and your responsibilities matter most in practice.
1. About these terms
Qojix is provided by QOJIX AI PTE. LTD., a company registered in Singapore (UEN 202633125H), at 7 Temasek Boulevard, #12-07, Suntec Tower One, Singapore 038987 ("Qojix", "we", "us"). By creating an account or using Qojix, you agree to these terms and to our Privacy Policy.
2. Who can use Qojix
Qojix is for professionals who hold a current licence or registration in their trade. For real estate in Singapore, that means a salesperson registration with the Council for Estate Agencies (CEA). We check this at sign-up and may re-check it at any time.
You must be at least 21. For property agents, this matches the Council for Estate Agencies' minimum age for registering as a salesperson.
Your account is personal to you. You contract with us as an individual professional; your agency is not a party to these terms and has no access to your account.
If you take part in a pilot programme, any separate written terms for that pilot apply as well. Where they conflict with these terms, the pilot terms win for that pilot.
3. What Qojix is
Qojix is business software that helps you run your own work with your own clients. Its features are organised as AI workers, each doing one job: creating marketing media, handling enquiries, arranging appointments, preparing briefings, updating property owners and checking content before it is published.
Qojix is not a general-purpose AI assistant and is not offered to consumers. People who message you are dealing with you and your business; Qojix works on your behalf, under your name and your settings. Qojix does not make or receive phone calls.
4. AI workers and your settings
You decide what each worker may do. For each type of action you can choose whether it happens automatically, is queued with a window for you to cancel, or waits for your approval. We set safe defaults and an upper limit for each action, and you can lower any of them.
Some things no worker ever does, whatever your settings: negotiate price, accept offers or deposits, agree commission terms, sign or send contracts, or disclose an exact unit number before a buyer is verified. These need you.
You are responsible for what is done under your settings. An action a worker takes within the level you allowed, or that you approved, is an action taken on your behalf.
Review what matters. AI can be wrong. Check facts, figures and media before relying on them, especially anything you approve.
The worker log records what each worker did and why. You can review it at any time; you cannot alter it.
You can pause all workers, or stop them on a single conversation, at any time.
5. WhatsApp
Qojix connects to your own WhatsApp Business account through the WhatsApp Business Platform, provided by Meta. The account and number remain yours.
Your use of WhatsApp is also governed by WhatsApp's own business terms and policies, including the WhatsApp Business Messaging Policy. You agree to follow them. If Meta restricts, suspends or changes your account, number or templates, that is Meta's decision and outside our control.
Meta bills you directly for WhatsApp messaging charges, using the payment method you attach to your WhatsApp Business account. Our fees do not include them.
Message templates you write are your responsibility. Our checks before you submit a template are there to help; Meta decides whether to approve it, and how it is categorised and priced.
Importing earlier chat history when you connect is optional. If you import it, only do so for chats you are entitled to use for your business.
6. Your clients and messaging rules
For the personal data of your clients and property owners, you are the organisation responsible under Singapore's Personal Data Protection Act (PDPA). Qojix processes that data on your behalf, as described in our Privacy Policy.
You confirm that you have the consent, or another lawful basis, needed to message the people you message through Qojix, and to use their data as Qojix does for you.
You are responsible for following Singapore's Do Not Call rules for any marketing message, and for honouring opt-outs promptly.
Only add a property owner for weekly reports if they are your client for that listing. They must confirm by email before reports start.
7. Advertising and licensing rules
You are responsible for everything published under your name and registration, including listing pages, storefronts, social posts and listing copy, and for meeting your licensing body's advertising rules.
Before Qojix publishes anything for you, it runs an advertising check. The check helps you catch common problems; it does not guarantee compliance and is not legal advice.
Only advertise a property you are authorised to market, with the owner's consent where your rules require it.
Do not remove or hide the labels Qojix applies to AI-generated or AI-altered media, and do not present a staged or rendered image as a photo of the property as it is.
8. Your content and AI output
You own your content (listings, photos, documents and other material you add) and the output Qojix generates for you (media, copy and messages), to the extent the law allows ownership of it.
You give Qojix a non-exclusive, worldwide licence to host, process, adapt and display your content and output, only to provide and support Qojix for you, including publishing it where you ask us to. The licence ends when the content is deleted, except for copies kept for legal reasons or in backups until they expire.
Because AI output is generated from patterns, similar output may be produced for other users. We don't promise that output is unique.
Your likeness. Only upload your own face and voice for avatars and voice narration. We record your consent before creating them, and you can delete them at any time.
You confirm you have the rights to everything you upload, including photos, music and floor plans.
Qojix, its software, design and brand are ours or our licensors'. These terms don't transfer any of those rights to you, apart from the right to use Qojix under them.
If you send us suggestions, we may use them without obligation to you.
9. Listings from other websites
You can bring in a listing by pasting its text or uploading a screenshot. Only do this for your own listings. Qojix does not access property portals or other websites to collect listings, and you must not use Qojix to do anything that breaches another website's terms.
10. Acceptable use
You must not use Qojix to:
break any law, or your licensing body's rules;
send spam, or message people who have opted out;
offer an AI chatbot or assistant service to the public, or resell or white-label Qojix without our written agreement;
impersonate anyone, or publish misleading, false or discriminatory content, including listings that exclude people by race, religion or nationality;
upload someone else's face or voice for an avatar or voice clone;
work around a guardrail, limit or authority setting;
access another user's data, probe or disrupt our systems, or copy or reverse-engineer Qojix;
upload malware or unlawful content.
11. Fees and billing
Plans are billed per professional, monthly, quarterly or yearly, in advance. Prices and what each plan includes are shown at sign-up and in the console.
Media credits included in your plan reset each billing period and don't roll over. Use beyond them, and one-off purchases such as onsite 360° shoots, are charged at the price shown before you confirm.
You can cancel at any time; your plan runs to the end of the period you've paid for. Fees for a period that has started are not refunded, except where the law requires.
Promotional prices apply only for the period stated, then the standard price applies.
We may change prices with at least 30 days' notice. A change applies from your next billing period after the notice ends.
Prices exclude taxes. Where GST or another tax applies, it will be shown on your invoice.
If a payment fails, we may limit your account after telling you and giving you reasonable time to pay.
12. Third-party services
Qojix works with services we don't control, including WhatsApp, Google Calendar, social media platforms and photography partners. Their terms apply to your use of them. We are not responsible for their outages, policy changes, decisions about your accounts, or their content.
13. Availability and changes
We work to keep Qojix available but don't promise it will be uninterrupted or error-free. We may carry out maintenance, ideally with notice.
We improve Qojix over time and may change or remove features. If we remove something central to your plan, we'll tell you in advance, and you may cancel.
Features marked as beta or preview are provided as they are and may change or end.
14. Suspension and closing your account
You can close your account at any time from Settings.
We may suspend or close your account if you breach these terms, if your licence or registration lapses or is revoked, if you don't pay, or if we must do so by law or to protect people or Qojix. Where reasonable, we'll tell you first and give you a chance to fix the problem.
After your account closes, you can export your content for a limited period. We then delete it as described in our Privacy Policy.
Sections 8, 15, 16, 17, 18 and 19 continue after your account closes.
15. Disclaimers
Qojix is provided "as is" and "as available". To the extent the law allows, we make no promises beyond those in these terms, including about accuracy of AI output, fitness for a particular purpose, or results such as leads, viewings or sales. Qojix does not give legal, financial or tax advice, and its checks do not replace your own professional judgment.
16. Limits on liability
We are not liable for indirect or consequential loss, or for lost profits, lost commissions, lost deals, or loss of data or goodwill.
Our total liability for all claims relating to Qojix is limited to the fees you paid us in the 12 months before the event giving rise to the claim, or SGD 700, whichever is less.
Nothing in these terms limits liability that the law does not allow to be limited, such as liability for death or personal injury caused by negligence, or for fraud.
17. Your responsibility to us
You agree to compensate Qojix for losses, costs and claims arising from your content, messages sent under your settings or with your approval, your advertising, or your breach of these terms, the law or your licensing rules.
18. Governing law
These terms are governed by the laws of Singapore. The courts of Singapore have exclusive jurisdiction over any dispute about them or about Qojix.
19. General
Changes to these terms: we'll post changes here and update the date. For significant changes, we'll give account holders at least 30 days' notice by email or in the console. If you don't agree, you can cancel before they take effect.
Whole agreement: these terms, the Privacy Policy and any pilot terms are the whole agreement between us about Qojix.
Assignment: you may not transfer your account or these terms. We may transfer them as part of a sale or reorganisation of our business.
Severability: if a court finds part of these terms unenforceable, the rest still applies.
No waiver: if we don't enforce a term straight away, we can still enforce it later.
Third parties: no one other than you and Qojix has rights under these terms under the Contracts (Rights of Third Parties) Act 2001.
